Welcome to Port Pilot! The terms “we”, “us” and “our” refer to Port Pilot. Port Pilot operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Port Pilot is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the Services.
1. Access and Account
You represent you are at least the age of majority in your jurisdiction and consent to any minor dependents using the Services on devices you own or manage. You may be asked for information (email, billing, payment, shipping). You warrant such information is accurate and that you have rights to provide it. You’re responsible for safeguarding your account credentials and all activity under your account. You may not transfer or license your account.
2. Our Products
We aim to represent products accurately, but colors/appearance can vary by device/settings. We do not warrant that any product will meet your expectations or appear exactly as depicted. Descriptions may change without notice. We may discontinue products or limit quantities by person, region, or jurisdiction.

Your order is an offer to purchase. We may accept, decline, modify, or cancel any order at our discretion. Orders are accepted when we confirm and process payment. Review your order carefully; cancellations may not be possible after acceptance. If we do not accept or change an order, we’ll attempt to notify you at the contact details provided. Purchases are subject to our Refund Policy. You represent purchases are for personal/household use, not for resale or export.
4. Prices and Billing
Prices, discounts, and promotions may change without notice. The price at checkout/confirmation applies. Unless stated otherwise, prices exclude taxes, shipping, handling, customs, and import charges. Promotions may have separate terms; if there’s a conflict, promo terms govern. You agree to maintain accurate purchase and payment details and authorize us to charge the amounts due (including taxes/fees). You warrant you’re authorized to use the provided payment method.
5. Shipping and Delivery
Delivery times are estimates, not guarantees. We’re not liable for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when we hand off items to the carrier.

The Services and all related content and materials are owned by Port Pilot or our licensors and protected by applicable laws. You may use the Services for personal, non-commercial purposes only. Except as permitted by law or with our written consent, you may not reproduce, distribute, modify, publicly display, or create derivative works of materials on the Services. Port Pilot names, logos, and designs are trademarks of Port Pilot. Shopify’s names and logos are trademarks of Shopify. Other names/logos are the property of their owners.
7. Optional Tools
We may provide access to tools from third parties on an “as is” and “as available” basis without warranties or endorsements. Your use is at your own risk and subject to the third party’s terms. New features/tools are also subject to these Terms.
8. Third-Party Links
The Services may contain third-party content or links. We don’t control or endorse such sites and aren’t responsible for their content, purchases, or policies. Review third-party terms and policies before transacting.
9. Relationship with Shopify
Port Pilot is powered by Shopify, but your sale is with Port Pilot. Shopify isn’t responsible for transactions between you and Port Pilot. You release Shopify and its affiliates from claims arising out of your purchases from Port Pilot.
10. Privacy
Personal information collected via the Services is governed by our Privacy Policy and may also be processed by Shopify as described in Shopify’s privacy policy. Information you submit may be transmitted to Shopify and service providers in other countries to operate and improve the Services.
11. Feedback
If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant Port Pilot a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any purpose. You represent you have rights to the Feedback and that it complies with these Terms and applicable law.
12. Errors, Inaccuracies, and Omissions
Information on the Services may contain errors or omissions (e.g., product descriptions, pricing, availability). We may correct, update, or cancel orders if information is inaccurate at any time without prior notice (including after an order is submitted).
13. Prohibited Uses
You may use the Services only for lawful purposes. You agree not to: violate laws; infringe IP rights; harass or harm others; transmit misleading or malicious content; spam or scrape; interfere with security features; or engage in conduct that restricts or harms others’ use of the Services. We may suspend or terminate access for violations.

We may suspend or terminate the Services or your access at any time without notice. Sections that by nature survive termination (e.g., IP, Feedback, Disclaimers, Liability, Indemnification, Governing Law) will continue to apply.

EXCEPT AS EXPRESSLY STATED BY PORT PILOT, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain disclaimers; in such cases, the above may not fully apply.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PORT PILOT AND OUR OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SERVICE PROVIDERS, AND LICENSORS (AND SHOPIFY AND ITS AFFILIATES) SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
17. Indemnification
You agree to indemnify and hold harmless Port Pilot, Shopify, and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law or third-party rights, or misuse of the Services.
18. Severability
If any provision is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remainder will remain in effect.
19. Waiver; Entire Agreement
Failure to enforce any right is not a waiver. These Terms and policies posted on the site constitute the entire agreement between you and us regarding the Services and supersede prior agreements.
20. Assignment
You may not assign these Terms or your rights/obligations without our written consent. We may assign these Terms without notice.
21. Governing Law
These Terms and any disputes are governed by the laws of the Commonwealth of Virginia, without regard to conflicts rules. You and Port Pilot consent to exclusive jurisdiction and venue in the state and federal courts located in Fairfax County, Virginia.

Headings are for convenience only.
23. Changes to Terms
We may update these Terms by posting a revised version with an effective date. Your continued use of the Services after changes are posted constitutes acceptance. We will provide notice of material changes as required by law.
